boston officials reveal some of their evidence against the boston marathon bombings suspect. >> reporter: in contra costa county a new budget calls for two more fire station closures. what firefighters say this could mean for the safety of your home. >> a little sneaky fog has moved back in along the coastline. what does it mean for our weather today? we'll talk about that coming up. >> they are picking up overnight roadwork in the east bay. northbound 880 approaching high street. the rest of your morning drive, we'll tell you coming up. good morning, everyone. it's tuesday, april 23rd. i'm michelle griego. >> hi, everyone. i'm frank mallicoat. 5:00. it was a bedside court appearance for the surviving suspect in the boston marathon bombings. >> the next legal step for johar tsarnaev is likely to be a federal indictment. he was questioned yesterday and wrote out his answers because his throat is injured. the 19-year-old tsarnaev indicated he and his brother were motivated by religious extremism. cbs reporter edward lawrence joins us now from boston with

more. good morning. reporter: good morning, michelle and frank. cbs news sources have learned actually that e -o t g that interrogation that he had a role in the bombings here at the marathon. he has a bail hearing and probable cause hearing on may 30th. 19-year-old johar tsarnaev's hospital room became a makeshift courtroom monday. a federal judge arraigned the terror suspect and announced he is being charged with using a weapon of mass destruction during boston marathon bombings last week. it killed three and injured 180. if convicted, he could face the death penalty. prosecutors believe he and his 26-year-old brother tamerlan placed two pressure cooker bombs on boylston street around the marathon finish line. tamerlan died friday in a shootout with police. johar is being treated for gunshot wounds here at beth israel hospital but despite being listed in serious condition, the judge said, i find that the death of is alert, mentally competent and lucid.

cbs news learned interrogators questioned johar in his ital be told them that he and his brother acted alone in order to carry out the marathon bombings. our sources say the tsarnaev brothers read jihadist websites but were not reportedly part of a terrorist group. because johar is a united states citizen the justice department is trying him as a civilian, not an enemy combatant. >> since 9/11, we have used the federal court system to convict and jail hundreds of terrorists. >> reporter: late monday night federal investigators swarmed an area behind a cambridge business where the father used to work on cars. officials placed a tarp over the scene to keep the search private. but they were filmed carrying out a box. the m.i.t. police officer who was murdered on friday, ambushed and murdered on friday, will be laid to rest today later on in a funeral service. that service will be private. there will be a public memorial service tomorrow. and vice president joe biden is expectbe at that public

service. reporting live in boston, back to you. >> so sad, edward. we've seen a lot of the victims being honored this week. let's talk about the teenaged suspect. do we know anything more about his condition? >> reporter: yeah. at this point heis still in serious condition and as you said in the beginning, he was not able to speak. he was communicating through nodding. he was also writing down his answers for the judge. at this point, he is recovering. but he is still in serious condition. >> and edward, how about boylston street? i understand the city finally got that back. they opened it up, right? >> reporter: yeah. there was a five-step process. it did open this morning. it's a major street here in boston and traffic was snarled, obviously, people needed to recover and see the memorial and honor the victims of the bombing. but again, this morning that street is now open. >> thank you, edward lawrence in boston. also from boston, a surprise visit to the hospital

room of 11-year-old aaron hern from martinez. her is recovering from injuries suffered in last week's bombings. ty waller, brandon moss and josh reddick of the as stopped by to see how he is doing. ♪[ music ] and aaron's classmates at martinez junior high wanted to make sure he knows they have his back. they sent him this get well video on youtube with signs there. his math teacher took her camera room to room to show kids offering signs of encouragement. >> pretty nice. >> that's a "cool school." >> really it is. >> nice. 5:04. officials on both side of the border do not think there is a connection between two terrorism suspects up in canada and the boston bombings. authorities say two men were scheming to derail a passenger train in the toronto area. the suspects are foreign nationals who do live in canada. officials say they were in the planning phase and were getting outside help.

>> the individuals were receiving support from al qaeda elements located in iran. >> two suspects have been under surveillance for more than a year now. they apparently didn't get financial help from al qaeda. this plot was not linked to the boston marathon bombings. in the wake of the boston bombings, san francisco is looking into a new way to secure its own streets. police chief greg suhr is thinking about setting up cameras along market street to monitor big events like parades that attract millions of people. >> i'm not talking about monitoring this day to day. i'm talking about during the events when there's 100,000 people up and down market street. >> cameras on market are not a new idea. there are plenty of private security cameras already up along the street. but police only look at them after the fact. the police chief will take his idea to the board of supervisors. how about the weather? it's never been so hot this time of year. temperature records fell all over the bay area yesterday

with some areas in the low 90s. but it's apparently going to be a little more comfortable today and you could feel it last night. good sleeping weather night before last it was hot. >> good sleeping weather? good ice cream weather, too. >> good ice cream weather, too. >> you never bought me the ice cream you said you were going to buy me. >> you said that? >> we have it on camera! >> i forgot. maybe today. [ laughter ] around the bay area today, we have patchy fog that's moved in along the coastline a sign of the sea breeze kicking in and temperatures beginning to cool down a bit. 40s in pacifica with dense fog but look inland. we have some winds kicking up and these temperatures almost 70 degrees right now in vallejo, a little windy there, also into napa. 67 degrees in livermore but in concord, where it's calm, only 54 degrees. here's the fog i was talking about. southerly surge along the coastline typical of what we see after a little heat wave. still today warm with slow cooling temperatures in the 80s and 90s yesterday. today cooling down especially

as you approach the coastline. still some mid-80s in the valleys but more cooling to come. we'll talk out thomg up. right now les check the roads with eth. be >> thank you, lawrence. you can see it is nice and light heading into san francisco on the bay bridge toll plaza. looking good in the east bay. overnight roadwork on the nimitz. you can see it in one of our live traffic cameras. looks like it's being cleared. we have that 880 camera we can show you so a little farther north of this camera where high street is that overnight roadwork being picked up. let's go to the dublin interchange westbound 580 starting to get busy now approaching 680 and dublin interchange. looking at the drive time for that stretch if you go to the maps it is now 20 minutes between the altamont pass and 680 so just a few taps of the brake lights as you get closer towards the livermore valley. similar story highway 4 in antioch getting busy now as you make your way towards the bay point area. drive times still in the clear on westbound 580 the nimitz and the eastshore freeway through ze. th is traffic. rds the

back to you guys. >> thank you. more fire at soon be closing in contra costa county. several jobs are on the line, as well. kpix 5 reporter cate caugiran is live in martinez this morning with more on the proposed cuts. >> reporter: we're live at what used to be station 12 in martinez and is now an empty building. this was one of the four stations shut down this year as part of budget cuts. the new budget is proposing two more station closures in the upcoming fiscal year. as for staffing, although 365 are recommended, the budget only calls for 293. firefighters are outraged over the proposed plan. they say more cuts are critical to the safety of the area. for example, this fire in september destroyed two homes in concord. firefighters said these fires response times were slower. and the president of the united professional firefighters of

contra costa county has already come out with a statement saying the plan is unacceptable and he says enough is enough. reporting live in martinez, cate caugiran, kpix 5. >> all right, cate, thank you. the contra costa county board of supervisors will be reviewing the proposed budget today at 9:00. a groundbreaking happens later this morning in burlingame for the first new public elementary school there in a half century. hoover elementary has not held students in more than 30 years. some neighbors want it to stay closed. they filed a lawsuit to stop the renovation project citing concerns about increased traffic on narrow roads. it is 5:09 now. a key step today in the court ordered reform of the oakland police department. a compliance director is expected to present his proposed work plan and budget to city officials later today. thomas frazier a former police chief in baltimore was appointed by a federal judge just last month. he has broad power to set an

action plan and to fire or demote top police officials. to the south now, a positive development for police in san jose. a new report finds that citizen complaints about the conduct of officers decreased last year by 7%. the number of complaints that resulted in officer discipline after internal review was also down. it went from 10% of cases in 2011 to just 3% in 2012. the report comes from a retired judge, who is now san jose's independent police auditor. a newspaper investigation finds that the state of nevada has been dumping psychiatric patients out of state. the "sacramento bee" finds as many as 1500 poor and mentally disabled patients got one way bus tickets from the state-run rawson neil hospital in las vegas. now san francisco's city attorney is launching his own investigation. >> patient dumping in itself is reprehensible and it's illegale

and he threw the ball back to the baseball player. good for him. he made the extra effort. outside on the roads, the "s" curve on the pedeckno major problems. no accidents. so yeah, easy ride into san francisco. hegenberger east bay, we had some overnight roadwork. it's in the clearing stages approaching high street. as you can see, if you are heading towards oakland coliseum, oakland airport, everything is moving at the limit. golden gate bridge traffic super quiet this morning all the way out of marin county. we haven't seen too many issues. they cleared the lanes change trucks so you can see the headlights heading towards the all-electronic pay gates getting into san francisco. and one more traffic camera. we sent our photographer this morning down towards 101 and south airport boulevard so if you are heading towards sfo this is what it looks like right now. free and clear in both

directions getting into san bruno. to our maps now, and some drive times for you. westbound highway 4 you can see a little bit of slowing on our sensors to the antioch exits but pretty much contra costa county is free and clear on highway 4, 242 and 680. your east bay drive times the nimitz once again eastshore freeway, that drive time is 19 minutes from the carquinez bridge to the maze. and bart we continue to check in with them. they should have 30 trains or so and everything is running like clockwork on time. that's a check of your "timesaver traffic." and we all love the weatherman today. let's go to lawrence to check our gorgeous forecast. >> i thought you guys loved me every day. >> when it's raining -- eh. >> my director says no. she doesn't. folks, and the bay area today we have some nice weather coming but we have seen some fog moving along the coastline and some of that is dense out sight. be careful on highway 1, thick fog there. mostly clear inside the bay. breezy in the valleys, some gusting to over 30 miles per hour. throughout the day today,

mostly sunny and again it's going to be mid-80s in the valleys. you will see 7and 80s side the y baand 60s with some patchy fog continuing out toward the coastline. high pressure sliding a little bit further to the north and now we're going to see low clouds and fog up from the south, prett typical. gradual cooling over the next few days and temperatures bottoming out in the middle of the week. sfo today, clear skies, no weather delays expected there, temperature of 74 degrees. around the state we have some trouble spots. into denver they are looking at more snow today. 37 degrees expected there for a high. chicago thunderstorms 55 degrees. 61 and mostly cloudy but dry in new york. around the bay today, sunshine continuing, 83 degrees and very nice in san jose. 80 in palo alto. 75 as you make your way into hayward. east bay temperatures mid-80s. not expecting records today although it will be plenty warm inland. 80 in novato, 83 santa rosa. ing to see the temperatures

[ laughter ] >> all right, guys. >> no open toes. the tsa has decided to delay a plan to allow passengers to carry small knives, bats and other sports equipment on airliners. the relaxed rules were supposed to go into effect thursday but the agency announced it would delay the ruling in order to give an advisory committee more me to consider feedback from various groups. there was no mention of how long that might take. a bill designed to take guns away from some californians has gone to the governor now. state lawmakers approved the plan to take more than 40,000 illegally owned guns off the streets. it would provide $24 million to

a program that takes guns from felons and the mentally ill. it is 5:19. some towns in the nation's midsection are trying to get ready for more high water from some major rivers there. an inch of rain expected to fall today from oklahoma to michigan. and that could raise crest forecasts for several rivers including the mississippi. a barrier in clarksville, missouri, just north of st. louis showed signs of strain on monday. the volunteers scrambled to build a second wall. a restaurant in iowa is staying open despite being surrounded by floodwaters. big muddies. it's living up to its name in a big wait a minute the mississippi river is 7 feet above flood stage but customers pleasantly surprised that it is open for business. >> makes you feel like you're on a boat. >> i thought i was on a cruise ship. i saw lots of water. >> still open. come in through the back door, bud. park on the back parking lot. >> i hear the mud pie is delicious. edward lawrence for cbs news, boston. >> there will be a private funeral today for slain m.i.t. officer sean collier. the tsarnaev brothers allegedly killed collier on the school's campus thursday night. a public memorial service is scheduled for tomorrow on m.i.t.'s campus. vice president joe biden is expected to attend. and we're hearing from the law officers who took suspect johar tsarnaev into custody on friday night. members of the transit police s.w.a.t. team made the arrest after a man found him hiding in a boat in his backyard. >> i saw the suspect sitting up on the -- i believe it's called the gunnel of the boat with one leg hanging over the side and his hands were just sort of down by his side. he looked weak. he was shaky, appeared to be losing consciousness. >> hear more from the s.w.a.t. team members on "cbs this morning." that's starting at 7:00 right

here on kpix 5. 5:31 now. two suspected terrorists have a bail hearing today up in canada. authorities say two men were scheming to derail a passenger train in the toronto area. suspects are foreign nationals. they lived in canada and had been under surveillance for over a year. officials say they were in the planning phase and were get direction and guidance from al qaeda in iran but no financial help. some developing news in libya at this hour. a car bomb went off at the french embassy injuring two french guards and a libyan teenage girl. the bomb detonated just outside the embassy building in the early-morning hours before any staff had arrived. the explosion set off a fire at the embassy entrance that engulfed some of the offices inside as you can see. it's a mess there. a motive for the attack still not clear. 5:32. we are following a developing story in the east bay in oakland. >> right. police have surrounded a home looking for a man that may have been connected to an earlier shooting. kcbs reporter tim ryan is with

police this morning at the home on international boulevard. tim, what can you tell us? >> reporter: michelle, this is an area of dense housing, not terribly far from the coliseum near 66th and international boulevard. police have surgeon rounded a building searching for -- have surrounded abufo a man linked to a shooting at 10:00 last night at 90th and cherry about five or 10 minutes from here. police say a man was shot in the leg by a male acquaintance nonlife-threatening injury. the man called police and told them who shot him. police came to this area. the man's car is apparently at this apartment building. so for hours, they have surrounded this building trying to talk the man out. whether they're sure that he is inside really is not clear although just within the last 10 or 15 minutes i heard some flash-bang devices go often that will be a prelude to an end so oakland s.w.a.t. is here trying to end this thing soon and to end this

safely. michelle? >> tim, this is frank. have they had any conversations with this guy throughout the night? this i have been there since 10:30 or so -- they've been there since 10:30 or so. >> reporter: as far as i know -- and i just e with an oakland police officer just minutes ago, hesays there have been no nvons. so this could, frank, just be one of those situations where they surround a home that turns out to be empty. but they are trying to bring this to an end safely. >> we're watching video now of all the police activities there. are they telling neighbors to stay in their homes. >> reporter: you know, i believe that they have not made any mandatory evacuations although someone who apparently was near -- and again, this is very dense housing. not much space in between that's buildings. apparently, at least one resident here decided that they would get out. other than that, people are mostly still asleep. the parking lot full of cars although of course some people

coming out are wondering what's happening in their neighborhood. >> tim ryan live with us with a developing story in oakland. tim, thank you. more fire station cuts could be coming to contra costa county. supervisors will on the issue later this morning. kpix 5 reporter cate caugiran tells us exactly what is on the chopping block. good morning, cate. >> reporter: good morning, michelle. now, the president of the united professional firefighters of contra costa county has already come out with a statement saying, enough is enough. the organization calls this plan unacceptable. as it stands, four stations have already been shut down in the past year and the new budget is proposing two more closures for the upcoming fiscal year. the staffing, although recommended at 365, is only budgeted for 293. now, firefighters already say the budget cuts could be the reason for delayed response times. for example, this fire back in september, two homes in concord fighrsaid, ie .

particular fires, onse timeses were slower than normal. today's meeting is scheduled for 9:00 this morning and the b new proposed budget at 10:00 this morning. reporting live in martinez, cate caugiran, kpix 5. >> the board decided to close the four stations last year after a $75 per year parcel tax failed to pass the november ballot. well, he's everyone's friend today, by golly. everyone loves the weatherman this week. >> just today. >> won't last long so i'm going to savor it. it was a gorgeous day yesterday. we had some record-breaking temperatures. today some fog at the coastline. so temperatures starting to cool down a bit but not bad as we are going to see plenty of sunshine throughout the day. still, the winds are kicking up in spots especially into the delta and the carquinez strait and some of the valleys. wind advisory in effect there. we could see gusts to 40 miles per hour so watch out for that if you are heading in that direction. still, beautiful skies over the bay and nice and clear right now. again, we have seen some patchy

dense fog move in along the coastline. where we're seeing some of the winds, the temperatures are up, already 67 degrees in livermore, calm in concord at 54. and 65 degrees a little breezy into santa rosa. as we head in toward the afternoon, we are expecting to move back into the 80s in san jose, cupertino and milpitas. east bay temperatures in the mid-80s not as warm as yesterday. a lot of 70s into the central bay. 75 in san francisco. about 79 degrees in oakland. we'll have more on your weather coming up in a moment. right now, let's check the roads with elizabeth. >> thank you, lawrence. and outside right now, if you are traveling 101, we are starting to see some extra cars right now on the roads open northbound 101, headlights you see there traffic heading out of san jose towards santa clara. things look overall pretty good. we are still not seeing any big accidents which is good news at 5:37 this morning. let's go out to check some of our bridges. here's a live look at the san

mateo bridge, westbound 92 so far at the limit out of hayward. and some of our maps now let's go check our sensors on highway 4. super slow, 15 miles per hour as you pass "a" street and lone tree. the peninsula still moving fine through redwood city all the way down into palo alto. and the only slow drive time we are really seeing is the altamont pass commute. 25 minutes between there and the dublin interchange. that's traffic. back to you guys. >> thank you, liz. it's 5:38. north vallejo little league is asking parents and relatives to leave their weapons at home. 200 little leaguers were benched last week after a noninjury shooting happened in the parking lot during a game. the shooting happened after a father and relative apparently got into an argument during a baseball game. >> i know it happened in vallejo but think it will happen on a baseball field during a t-ball game where little kids are playing. >> they were heartbroken. they want to play baseball. nothing out them for them to do here positive, the only thing.

's why we see it pretty clear in the middle lanes, in the fastrak lanes. that's usually our first indicator that they've turned them on but right now minimal delays getting into the city. checking the roadway sensors, these are current conditions out there right now. if you are traveling the eastshore freeway, 65 miles per hour. and it's pretty quiet through richmond, berkeley, all the way down towards the macarthur maze. i just checked that drive time. it's about 19 or 20 minutes from the carquinez bridge to the maze. this is one of our slower spots usually is this time of the morning from the altamont pass to the dublin interchange. about 27 minutes right now. so it's actually a little backed from up 205 coming out of tracy. mass transit had no hiccups all day. bart systemwide on time. bart, muni, caltrain and ace no delays. that's a check of your "timesaver traffic." back to you guys. >> thank you. 5:46 now. more earnings reports coming out today including apple, at&t and delta airlines. three biggies. nearly one-third of the

companies in the s&p will report their results this week alone. the reports have been pretty good so far. on wall street the dow reversed an early slide yesterday and gained 19 points. the nasdaq climbed 27. stock indices have more than doubled since the march 2009 bottom. but many investors still a little spooked by the markets. here to explain why is jill schlesinger, cbs news senior business analyst. >> reporter: good morning. >> ordinary investors might pile into stocks. tell us what's going on. >> reporter: well, it's so wild because the financial crisis and the subsequent 55% drop in stock indexes clearly have lot of a lasting impression on investors. according to bankrate.com's financial security index, a whopping 76% of respondents say they are just saying, no to

stocks. that's a huge number. economists call this recency bias. we tend to use our resent experience as a guide for what's going to happen in the future. sohen stocks are soaring, we think markets are just going to keep on going up. but when the market plunges, we become convinced they will never rise again. >> well, so where is all the money? people are making money since 2009. are they hoarding it? is it in mattresses out there? where is it all? >> reporter: european mattresses with safes in them. [ laughter ] >> reporter: most of these folks are clinging to the perceived safety of bonds. according to the investment company institute, since the financial crisis began, stock mutual funds saw outflows 66% of the time. investors yanked out almost half a trillion dollars from their stock mutual funds. meanwhile, bond funds reported in flows 81% of the time. so, you know, adding stocks to bonds. here's a warning. bond prices can fluctuate.
